OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY. A PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
- 1. Eligibility
The Lesson Plans Page “Just For Teachers” Back To School contest is open to residents of the 50 United States and the District of Columbia aged twenty-one (21) or older who are active licensed teachers. Employees of Lesson Plans Page, HotChalk, and affiliated entities, and each of their respective advertising and marketing agencies (collectively all of these entities to be referred to as the “Contest Entities”) and members of such employees’ respective immediate families (parent, spouse, child, sibling, grandparent and grandchild) regardless of whether they reside in the same household, and members of the same household of such employees, are not eligible to enter. Void where prohibited. All applicable federal, state, and local laws and regulations apply. - 2. How to Enter
The Contest begins at 12:30 p.m. Pacific Time (“PT”) on June 17th, 2013 and ends at 12:45 p.m. PT on October 1, 2013 (“Contest Period”). Limit one (1) entry per person. Entry forms may be completed at www.LessonPlansPage.com. - 3. Winner Selection
On or about October 4, 2013, after the close of the Contest Period, a random drawing will be conducted by Sponsor to select one (1) grand prize winners, ten (10) first place winners, and five hundred (500) second place winners. The odds of winning depend on the number of eligible entries received. The winners will be notified by phone or e-mail, in the Sponsor’s sole discretion. If a winner does not respond to the prize notification within the time set forth therein, he/she may be disqualified in the sole discretion of the Sponsor and an alternate winner randomly selected from the remaining eligible entries.
No assignment or transfer of the prizes will be permitted, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize with one of comparable or greater value if an advertised prize is unavailable. Prizes cannot be redeemed for cash. Winner is solely responsible for all federal, state and local taxes associated with the receipt of any prize. Winners will be issued a Form 1099 in the amount of the prize, provided, however, that Sponsor will gross up the amount of the prize to cover the estimated applicable taxes on the prize for the winner. - 4. Prizes
Five hundred and eleven (511) prize winners will be selected. The grand prize is an Apple MacBook Pro with Retina Display (Approximate retail value (ARV) of the prize is US $2,400.) Ten (10) first place prizes will be Apple iPad 2s (Approximate retail value (ARV) of the prize is US $399 each). Five hundred (500) second place prizes will be twenty-five dollar ($25) gift cards (Approximate retail value (ARV) of the prize is US $25.). The winner is not entitled to any difference between the ARV and actual value.Documents and Releases
(a) Winners must sign an affidavit of eligibility and a liability/publicity release (unless prohibited) as well as any required W-2 and other tax-related forms (“Sweepstakes Documents”) and return the Sweepstakes Documents within 7 days of the date sent by Sponsor. Failure of the prize winners to return the Contest Documents within the specified time period shall be grounds for disqualification and the selection of an alternate winner by a random drawing of the remaining eligible entries.(b) By participating in this contest or receiving a prize, entrants agree to release and to indemnify and hold harmless the contest entities and each of their officers, directors, employees and agents from any liability, injury, death, loss or damages to entrant or any person or entity, including without limitation, damage to personal or real property, caused in whole or in part, directly or indirectly, by participation in this Sweepstakes (or related activities) or the acceptance, possession or use/misuse of the prize, or any prize-related travel or activity.
(c) Except where prohibited, winner grants consent for the Sponsor Entities to use his/her name, likeness, voice, opinions and biographical information for publicity, advertising, trade or promotional purposes in any media or manner, now known or hereafter devised, worldwide, without further payment, consideration, notice or approval.
- 5. Entry Errors/Cancellation of Sweepstakes
(a) Sponsor is not responsible for lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries. Sponsor is not responsible if online service or equipment is interrupted including without limitation (1) interruptions to any network, server, Internet, Web site, telephone, satellite, computer or other connections, (2) failures of any telephone, satellite, hardware, software or other equipment, (3) garbled, misdirected or jumbled transmissions, or traffic congestion, or (4) other errors of any kind, whether human, technical, mechanical or electric, or (5) the incorrect or inaccurate capture of entry or other information or the failure to capture any such information.
(b) If for any reason, the contest cannot be conducted in a manner contemplated by these Official Rules, Sponsor may modify or terminate the contest and award prizes to those who entered prior to the time of termination. Sponsor reserves the right to modify or discontinue the contest at any time without prior notice.(c) Sponsor reserves the right to disqualify any entrant found tampering with the entry process or with the operation of the sweepstakes or who violates these Official Rules. Caution: any attempt by an entrant to deliberately damage or undermine the legitimate operation of the contest may be in violation of criminal and civil laws and will result in disqualification of such entrant. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney’s fees) from any such entrant to the fullest extent of the law, including criminal prosecution.
- 6. Acceptance of Official Rules As a condition of entry, entrants fully and unconditionally agree to these Official Rules and to Sponsor’s and Administrator’s decisions, which are final and binding in all respects and to be contacted by phone, email or mail with respect to the contest.
- 7. Disputes/Choice of Law/Limitation of Liability
Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this contest or any prize awarded shall be resolved exclusively by state or federal courts situated in the State of California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation, lost profits, may be awarded (collectively, “Special Damages”), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California law, without reference to choice of law rules, governs the Sweepstakes and all aspects related thereto. - 8. Privacy
Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select the prize winner and fulfill the prize, and will be treated in accordance with Administrator’s privacy policy accessible at http://www.hotchalk.com/privacy-policy, except that such information may be shared between Lesson Plans Page and its strategic partners, as well as its contest Administrator, HotChalk, Inc. - 9. Winner List
For the name of the winner, send a self-addressed, stamped envelope by December 31, 2013 to: HotChalk C/O: Winner Request for LessonPlansPage Drawing 2013, 1999 S Bascom Ave, Suite 1020, Campbell, CA 95008. Winner’s list will be available after November 1, 2013. Residents of Vermont may omit return postage. - 10. Sponsor
